Malta has
always had a heavy emigration in particular to the U.S.A., Australia,
Canada and the U.K. and there are hundreds of thousands of Maltese persons
living abroad. This invariably leads to complications concerning
inheritances. Maltese persons living abroad may leave property in
Malta when they pass away, or they may inherit property in Malta while
being abroad. In both cases Maltese law, as the lex situs, would
apply to the devolution of this property and in many cases it is difficult
to make any progress in these matters without legal assistance.
There are succession (inheritance) taxes to pay, contracts to be signed
and many times agreement has to be reached about partitioning the property
with other heirs.
